Terms of Service

App: Phone Dialer: Calls & Contacts

These Terms of Service ("Terms") are the agreement between you and the developer ("we", "us", "our") under which the Phone Dialer: Calls & Contacts application (the "App") is provided. Downloading, installing or using the App binds you to them. If they are not acceptable to you, the App should not be used.

1. What the Service Is

The App is a dialer with a contact organiser built in. You may arrange and search contacts, ring out and take calls, look through call history, identify a caller before answering, and block or filter numbers you would rather avoid. Which features are available turns on the permissions granted, on the handset, and on whether the App has been made the default dialer.

2. Free Tier and Subscription

The essential contact and calling functions cost nothing, and that free tier is funded by advertising. A subscription has two effects: advertising is switched off and the premium functionality is unlocked. What a subscription covers is identified within the App and may be extended or adjusted as the App develops.

3. Billing, Renewal and Cancellation

Subscriptions are sold only through the Google Play billing system at the price shown before confirmation. Without prior cancellation a subscription renews automatically at the end of each billing period, the charge going to your Google Play account under Google's terms. Cancellation happens in the Play Store under "Subscriptions"; the subscription then runs to the end of the period already paid for and access is kept until that point. Uninstalling the App cancels nothing at all — only the Play Store can end a subscription.

4. Refunds

Refunds fall under the Google Play refund policy and are assessed and paid by Google rather than by us. Where a charge looks to have been applied in error you may also write to us and we will help so far as we can, though the final decision on any Play Store refund rests with Google.

5. Minimum Age; Purchases by Minors

Use is permitted from 13 years of age, or from any higher minimum age the law of your jurisdiction sets. A person aged between 13 and 18 needs the permission of a parent or legal guardian, who thereby accepts these Terms on that person's behalf.

A subscription or purchase made by a minor is valid only where a parent or legal guardian gave prior consent. An adult who permits a minor to use a handset signed in to that adult's Google Play account carries responsibility for purchases made from it. The effective safeguard is purchase authentication within Google Play — requiring a password or fingerprint before each purchase — and we recommend it on any handset a child can reach. Where an unauthorised purchase has still occurred, recourse lies through the Google Play refund process.

6. Acceptance and Later Amendment

Use of the App constitutes acceptance of these Terms. Amendments may be made; the version currently operative, bearing its effective date, is invariably published on this page, and continued use after an amendment constitutes acceptance of it. Where an amendment is unacceptable, discontinuing use of the App is the remedy available.

7. Data the App Uses

Subject to the permissions granted, the App works with contact entries, call records and associated device data so as to furnish dialling, caller identification, call history and blocking. Particulars appear in our Privacy Policy, which forms part of these Terms. Personal data is not sold, and disclosure is confined to the providers identified there.

8. Obligations of the User

The App is for lawful purposes only. Responsibility for how its dialling, blocking and reporting functions are used — including compliance with the law of your jurisdiction — rests with you, as does the accuracy of the contact information you keep within it. The App must not be used to harass any person, to submit false spam reports, to interfere with emergency communications, to circumvent the subscription, or to obtain unauthorised access to any connected system. The App must in no circumstances be your sole means of contacting emergency services; the handset's native emergency dialling must remain available at all times.

9. Controls Available to You

Permissions may be withdrawn in Android's settings; contact entries amended or deleted; call history cleared; blocked numbers released; the default dialer changed; and the App uninstalled — each at any time and at your sole discretion.

10. Proprietary Rights and Licence

The code, design, graphics and other materials originating with us are our property and enjoy the protection of intellectual property law. You are granted a limited, personal, non-exclusive, non-transferable licence to use the App, together with any premium functionality a subscription unlocks, for private and non-commercial purposes. Reproduction, modification, redistribution, sale and reverse engineering are prohibited without our written consent. Your contact entries and other content of your own remain yours throughout.

11. Advertising

Where no subscription is in force, advertising is displayed through third-party networks such as Google AdMob. Any relationship arising between you and an advertiser subsists exclusively between the two of you; we accept no responsibility for third-party advertising content or for the goods and services it promotes. Advertising ceases for the duration of an active subscription.

12. Disclosure

Information may be disclosed where the law requires it, or where disclosure is reasonably necessary to prevent fraud or abuse, to protect the rights and safety of users, or to enforce these Terms.

13. Termination

You may end your use of the App at any time by uninstalling it — noting that a subscription survives uninstallation and requires separate cancellation through the Play Store. Access may be suspended or terminated by us without prior notice where these Terms are breached, where the law obliges us, or where continued provision of the App would expose us to legal or operational risk. Provisions which by their nature ought to survive termination — proprietary rights, disclaimers, limitations of liability — continue in effect.

14. Exclusion of Warranties

The App is furnished "as is" and "as available", without warranty of any description, express or implied. No representation is made that operation will prove uninterrupted or free from error, that every unwanted or spam call will be intercepted, that caller identification will invariably be accurate, or that defects will be remedied.

15. Limitation of Liability

To the fullest extent permitted by law, no liability attaches to us for indirect, incidental, special, consequential or punitive damages — including missed or failed calls, loss of data, loss of contact entries, loss of profit and device malfunction — arising from use of the App or from any inability to use it, notwithstanding that the possibility of such damage may have been drawn to our attention.

16. Disputes

Please write to us first at the address below; the overwhelming majority of matters are resolved that way. Where informal resolution proves unsuccessful, the dispute shall be determined under applicable law before the competent courts of the place in which the defendant is located, save where mandatory law directs otherwise.

17. General

Should any provision of these Terms be held invalid or unenforceable, the remainder shall continue in full force. A decision not to enforce a provision on any given occasion operates as no waiver of it.
